NOTE: Collaboration and Remix happen within a closed system of Intellectual Property protections. Copyright exists in perpetuity - though it is not outlined as such by law - in that each time an extension of current limits becomes necessary, the estates and/or corporate interests who administer rights for valuable material (Disney’s interest in Mickey’s protection) lobby congress and effectively pass new legislation. Traditionally, copyright is thought not to exist in perpetuity by virtue of the Copyright Clause. Projects, such as this collaboration between Medicom and Disney confound proponents of more open IP protections, in that they mark the generation of new materials that are derivative of old, protected ideas. Strict IP protections are thought to hinder creativity and collaboration; sometimes true; not always. Loosening of IP law is useful insofar as it helps amateur creators and students to develop their craft, but where professionals are concerned, we should expect them to pay for what they use and to share in the profits. Just because art or ideas constitute the core of a transaction does not mean that the firms involved have any less right to profit than if they were trading in traditional industrial goods.
